Pre-Underwritten Escrow Defense: Eliminating Financing Pitfalls Before Opening Escrow

By Julayne Luu

Most escrow trouble starts with financing. Learn the common pitfalls, and how earlier verification helps both buyers and sellers protect a transaction.

Escrow is the period between an accepted offer and the day the property closes. It is also when many transactions encounter their greatest risk. While inspections and title issues can cause problems, financing is one of the most common sources of delay or failure. The solution is not luck. It is preparation. Pre-underwriting means resolving financing questions before the contract is signed, so that fewer surprises appear once the clock is running.

Why Financing Problems Arise

Common causes include:

  • Incomplete verification. An approval based on stated information may unravel when documents are reviewed.
  • Appraisal shortfalls. The property appraises below the contract price, creating a gap between the loan and the price.
  • Changes in the borrower's profile. New debt, job changes, or large unexplained deposits can alter qualification.
  • Documentation delays. Slow responses to lender requests can push a file past contract deadlines.
  • Property issues. Condition, insurance availability, or title problems can prevent a loan from moving forward.
  • Rate lock expiration. A lock that expires before closing can change the cost.

What Pre-Underwriting Looks Like

Terminology varies, but the concept is consistent. Before making offers, the buyer submits a full application and documents. The lender, and often an underwriter, reviews income, assets, credit, and liabilities, and issues a conditional approval with clearly identified remaining items. The remaining conditions typically relate to the property, such as the appraisal, title, and insurance.

Benefits for Buyers

  • Credibility. Sellers prefer buyers whose financing has been reviewed.
  • Speed. Many documents are already collected, so you can respond faster.
  • Clarity. You know your budget, payment, and any conditions in advance.
  • Fewer surprises. Problems can be solved before you are under contract.

Benefits for Sellers

Sellers also gain from stronger financing:

  • More reliable offers. Verified financing reduces the odds of fall-through.
  • Better comparisons. You can evaluate offers on risk as well as price.
  • Shorter timelines. Faster approvals can help meet closing dates.

Ask for lender letters, proof of funds, and an explanation of how the buyer plans to handle appraisal and contingency timing.

Defend Against the Appraisal Gap

If a property appraises below the price, the buyer and seller have several options:

  1. Renegotiate the price
  2. Have the buyer bring additional cash to cover the difference
  3. Split the difference through a combination of price reduction and buyer funds
  4. Challenge the appraisal with additional comparable sales
  5. Cancel under the appraisal contingency, if one remains in place

Buyers who plan for a possible gap before writing an offer are better prepared to decide quickly. Sellers who price thoughtfully are less likely to face one.

Manage Contingency Timelines

California contracts typically include time periods for inspections, appraisal, and loan approval, often measured in a couple of weeks. Missing a deadline or removing a contingency prematurely can put deposits at risk. Track dates closely, and communicate with your lender and agent regularly.

Keep the Profile Stable

Until the loan closes:

  • Do not open or close credit accounts
  • Do not make large purchases on credit
  • Do not change employment without discussing it with your lender
  • Keep your funds in verified accounts, and document large transfers
  • Respond to lender requests within a day

Coordinate the Team

A smooth escrow relies on communication among the agent, lender, escrow officer, title company, and insurance provider. Confirm that everyone has current contact information and a shared timeline. Verify wire instructions by phone, since fraud attempts often target this stage.
